HIPAA
 Effective April 14, 2003, a new federal law went into effect: the Health Insurance Portability and Accountability Act of 1996, or "HIPAA". One of the purposes of HIPAA is to ensure health care providers who collect health care information about individuals have procedures in place to keep the information private. Because the Bismarck Special Education Department bills Medicaid for some services, it is considered a "health care provider" under the law. Prior to billing Medicaid, the Department provides parents with a Notice of Privacy Practices.

Notice: Destruction of Records
 The Bismarck Public Schools Special Education Department intends to destroy the special education records of students who graduated or last attended the district between the years of 1997 and 2003. Such records are no longer needed for educational purposes. Former students (or legally appointed guardians) who wish to obtain their records prior to destruction must: (a) complete and mail the form found below or (b) put their request for these records in writing and mail to Kathy Mickelson, BPS Special Education Department, 806 N. Washington, Bismarck ND 58501. Requests must be received by the Special Education Department by December 15th, 2008.
Please allow 30 days for processing requests.
